CITY OF ANOKA <br />CONTRACT FOR FIILE PROTECTION <br /> <br /> YEAR 1980 <br /> <br /> THIS AGRE~NT, made and e~_teled into by and between the City of Anoka, a <br />Municipal Corporation, of the County of Anoka and State of Minnesota, party of the <br />first part, hereinafter referred to as the "City", and the City/Township of <br /> <br /> Ramsey in the County of Anoka , State of Minnesota, party of the <br /> <br />second part. <br />WITNESSETH: <br /> <br /> That in consideration of the sum of Eight thousand~ three hundred sixty nine <br /> <br />.aDd 27/100 ($8~369.27) Dollars per year, payable in advance by second <br /> <br />party to said City, said City agrees to furnish fire service and protection to the <br /> <br />property located in said City/Township of Ramsey ., for the compensation <br /> <br />and on the' conditions hereinafter set forth, and the said City fur'ther agrees that <br />when called to property located in the City/To~ship of Ramsey __, its <br /> <br />firemen will make a reasonable effort to attend fires on said property, PROVIDED, <br />HOWEVER: <br /> <br /> 1. That the road and weather conditions be such that the fire run can be <br /> <br />made with reasonable safety to men and equipment, and the decision of the Anoka <br /> <br />Fire Chief or other fire department officer in charge shall be final in such matter. <br /> 2. Thai in the event that all fire apparatus and all members of the Anoka <br /> <br />Fire Department are busy at the time a call comes in from said second party, the <br /> A~oka Fire Department will call for mutual aid and any other help that might be <br /> available, because of the emergency or disasterous natur~ of the situation. However <br /> if all means of providing service are exhausted, and in the discretion of Anoka City <br /> officials and Fire Chief or other fire department officer in charge, such apparatus <br /> and members of said fire department are needed in Anoka, the City shall be held free <br /> and relieved from all liability to make said run or to respond to said call. <br /> <br /> 3.. In the event the Anoka Fire Department is fighting a fire in the City/ <br /> <br />Township of Ramsey and a fire breaks out in the City of Anoka, the Anoka <br /> <br />Fire Department will not leave the City/Township Ramsey fire unattended. <br /> <br />The Anoka Fire Department will either remain to fight the fire or will provide ser- <br />vices from another municipality through mutual aid agreement. <br /> <br /> 4. If for any reason the Fire Chief or other fire department officer shall <br />decide that no equipment or fire fighters can be spared, the decision of the Fire <br />Chief or other fire department officer shall be final. <br /> <br /> 5. That said City shall not be liable in any way to the second party or to any <br />other person, firm or corporation for failure of the Department of said City to at- <br />tend a fire or to extinguish a fire or for any damage to or loss of goods, or for <br />any act, omission, or for any other reason. <br /> <br /> 6. That in addition to the above mentioned sum of Eight thousand, three hundred <br /> sixty nine and 27/100 ($8,369.27) Dollars per year, said second party <br /> <br />agrees to pay as compensation for services rendered hereunder, the actual cost of <br />each run made by the Fire Department to said City/Township when called by said <br />~econd party or when made for the benefit of said second party or when made to a <br />place within the boundaries of said second party, said sum to be paid when billed <br />hy City. Said comt of run to be based on the following schedule: <br /> <br /> One Hundred Fifty and no/100 ($150.00) per run for the first hour <br /> or fractlo~ thereof. <br /> <br /> Sixty and no/100 ($60,00) for each additional one-half hour or <br /> fraction thereof. <br /> <br /> <br />
