Conditions of'Agreement (continued) ~ i 1. Applicant shall submit to the City of.~Ramsey foul's.. (~') copies of the final site plan which conforms to all City of Ramsey conditions of approval within ten (10) days following the date of City Council approval. One copy will be stamped approved by the City of Ramsey and returned to the Appl ~ cant. ~ Applicant shall complete his building or facility no later than ~L%/ .~/ 19-~, and all landscaping and other site ~-6-rn2--~ .]~e st'amped appro~ve'd final site plan no later than Applicant shall deposit with the City of Ramsey, a cashiers check, irrevocable letter of credit, performance bond, or other suitable security acceptable to the City of Ramsey in the amount of 150 percent (150%) of the cost of completing all landscaping improvements to include plantings, final site grading, fencing, lighting, driveways or parking areas, and curbing· Applicant shall substantiate his costs for all landscaping improvements to the City Administrator, or his' representative. Applicant acknowledges that failure to cozmplete the landscaping improvements defined above bY t~' !~ l t.~ :.'/ 19/z~, shall result in forfeiture of the financial guarante~es provided to the City of Ramsey in Item 3. Applicant shall notify the City of Ramsey at least 72 hours in advance of the date Applicant is ready for final inspection of his site, and of his request for release of the financial guarantees provided to the City of Rantsey in Item 3. As applicant complies by comple'ting the site conditions defined under Item 3, the City of Ramsey may release all, or any portion, of the financial guarantees upon written request to the City of Ramsey, however in no event shall the City of Ramsey relaease any amount which would reduce the remaining guarantee below 150% of the cost to complete all remaining site conditions. If applicant does.not commence construction is his project, including physical facilities, within sii (6) months following approval of this agreement, the City Council approval shall be considered null and void for the entire project, unles's an extension is granted by the City Council.
