been satisfied by the Developer, the City shall issue a permit to the <br />Developer for the construction of the proposed Development. <br /> <br /> III. <br /> <br /> Developer shall provide and stripe the number of spaces <br /> <br />which are required by the City Zoning Ordinance in existence at the <br /> <br />time of execution of this Contract for parking. <br /> <br /> Developer shall install a 1250 gallon septic tank with 400 <br />square feet of drainfield for washing of Berg Oil trucks. The water <br />usage amount will be approximately 150 gallons per day. <br /> <br /> Developer shall show room for two additional drainfields and <br /> <br />a flammable waste trap to be installed. <br /> <br /> Developer to install a drain spout on the roof with a swale <br /> <br />to direct the water to a dry well located on Berg Oil property. <br /> <br /> Developer to install Clas~V and/or Limerock material for the <br />driveway next to the proposed new building. <br /> <br /> Developer to construct the building with a setback from the <br />rear property line of 35 feet, as shown on Site Plan "C". <br /> <br /> The building construction shall be as shown on the construction <br />plan, Job No. 79-123, 8-21-79. <br /> <br /> The Developer shall provide the City with a performance bond <br />or cash escrow in the amount of $5~-4~.-~to ~nsure that all requirements <br />are completed as shown on the site plan and as provided for in this <br />contract. <br /> <br />Ail provisions and requirements of this contract shall run <br />with the land and become the obligations of the Developers' heirs and <br /> <br /> <br />
