'A':"N 'N" State Planning cy STATEOFMINNESOTA 0 morandum TO FIIOM : SUBJEC'f: · Planning and Regulatory Agencies and Units of Government Within the River Corridor Critical Area Clifton Aichi nger,Coordinator ~~~ Critical Areas Program Proposed Procedures for Reviewing Critical Area Plans Amendments and Discretionary Actions The Mississippi River Corridor Critical Area Designation Order and the Critical Area Rules and Regulations require that all proposed amendments to EQB approved Critical Area plans and regulations be reviewed by the EQB prior to their adoption at the local level. The designation order also states that all plans and regulations should be re-evaluated every two years and that the review procedure for amendments and re-evaluations shall be the same as for the original plans and regulations. The Designa- tion Order allows the EQB to limit the type of discretionary permits to be reviewed. Through our experience with the administration of the Mississippi River Corridor Critical Area Interim Development Regulations we feel it is unnecessary and undesireable to review all discretionary activities. The attached procedures should clarify the types of actions requiring review and the review process to be followed. The procedures are identical to the Interim Development Regulation administrative procedures except that the ability of the Metrolopitan Council to order a public hearing was removed. To provide for easier reference and ease of local administration, the procedures for review of plan and regulation amendments and procedures for review of disCretionary actions have been combined into one administrative procedures document. Also included are several definitions and the listing of the types of discretionary, actions and amendments to be reviewed.
