Commissioner introduced the following resolution and moved for its adoption: <br /> RESOLUTION#16-10-180 <br /> A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO THE FRONT <br /> YARD SETBACK ON THE PROPERTY LOCATED AT 16062 RHINESTONE STREET <br /> NW,AND DECLARING TERMS OF SAME. <br /> WHEREAS, Greg Bauer of Trilogy Homes, Inc. (Permittee), has properly applied for a <br /> variance (the "Variance") from the front yard setback in the R-I Residential (MUSA) District on <br /> the property generally known as 16062 Rhinestone Street N.W. and legally described as follows: <br /> Lot 1, Block 6, Sweetbay Ridge, Anoka County,Minnesota <br /> (the "Subject Property"); and <br /> WHEREAS, the Planning Commission met on October 6, 2016, conducted the public <br /> hearing and adopted findings of fact relating to the request for a variance from the front yard <br /> setback requirements on the Subject Property. <br /> NOW THEREFORE,BE IT RESOLVED BY THE PLANNING COMMISSION OF <br /> THE CITY OF RAMSEY,ANOKA COUNTY, STATE OF MINNESOTA, as follows <br /> 1. Based on Findings of Fact 90967, a Variance to construct a new single family dwelling <br /> within the required front yard setback area on the Subject Property is hereby granted. <br /> 2. That the dwelling on the Subject Property shall maintain a front yard setback of twenty- <br /> five (25) feet from the public road right-of-way as shown on the attached Exhibit A. <br /> 3. No construction shall commence without first obtaining a Building Permit from the City. <br /> 4. That this Variance shall automatically expire if the use is not initiated by October 6, 2017 <br /> and issuance of a Building Permit shall constitute initiation. <br /> 5. That the Permittee acknowledges that there shall be no impact to the wetland, including <br /> placement of fill (topsoil and sod), throughout the duration of the project. <br /> 6. That the Permittee acknowledges that no part of the structure (excluding the eave <br /> overhang) shall encroachment into the drainage and utility easement. <br /> 7. The Permittee shall be responsible for all City costs incurred in administering and <br /> enforcing this variance. <br /> The motion for the adoption of the foregoing resolution was duly seconded by Commissioner <br /> and upon vote being taken thereon, the following voted in favor thereof: <br />
