Commissioner introduced the following resolution and moved for its adoption: <br /> RESOLUTION#16-10-182 <br /> A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO FRONT YARD <br /> AND SIDE CORNER SETBACK IN THE PROPOSED PLAT OF BROOKFIELD 8TH <br /> ADDITION AND DECLARING TERMS OF SAME. <br /> WHEREAS, Brookfield Land, LLC (Permittee), has properly applied for a variance from <br /> the minimum front yard and side corner setback length prescribed in Section 117-111, Subd. (d) <br /> on portions of the property legally described as follows: <br /> Outlot A, Brookfield 2nd Addition, Anoka County, Minnesota <br /> Or upon platting and recording: <br /> Lots 1-10 (inclusive) Block 1, and Lots 15-16 Block 2, Brookfield 8th Addition,Anoka <br /> County, Minnesota <br /> (the "Subject Property"); and <br /> WHEREAS, the Planning Commission met on October 6, 2016, conducted a public <br /> hearing and adopted Findings of Fact 90968 relating to the request for a variance to the minimum <br /> front yard and side corner setback on the Subject Property. <br /> NOW THEREFORE,BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF <br /> THE CITY OF RAMSEY,ANOKA COUNTY, STATE OF MINNESOTA, as follows <br /> 1. Based on Findings of Fact 90968, a five (5) foot variance to the thirty (30) foot front yard <br /> and side corner setback, as established in Section 117-111, Subd. (d) of the Ramsey City <br /> Code,is hereby granted for the Subject Property and as shown in the attached Lot Exhibit. <br /> 2. That the Variance requires a front yard and side corner setback of 25 feet as shown on the <br /> attached Lot Exhibit. <br /> 3. No construction of any building shall commence without the issuance of a building permit. <br /> 4. The Permittee shall be responsible for all City costs incurred in administering and <br /> enforcing this variance. <br /> 5. That this Variance shall automatically expire if the use is not initiated by October 6, 2017, <br /> and successful recording of the plat of Brookfield 8th Addition shall constitute initiation. <br /> The motion for the adoption of the foregoing resolution was duly seconded by , and <br /> upon vote being taken thereon, the following voted in favor thereof: <br />
