Community Development Director Gladhill requested the Commission now review the lot depth <br /> standards variance. <br /> Motion by Commissioner Bauer, seconded by Commissioner VanScoy, to adopt Resolution 916- <br /> 10-189 - Approving Findings of Fact 90970 for Variance to Lot Depth Standards and Resolution <br /> 416-10-190 - Approving Issuance of Variance to Lot Depth Standards for Lot 16, Block 2 and <br /> Lot 1, Block 1. <br /> Further discussion <br /> Community Development Director Gladhill requested the Commission make a determination on <br /> Lots 3 and 4. <br /> Friendly Amendment: Motion by Commission Bauer, seconded by Commissioner VanScoy to <br /> recommend Lots 3 and 4 be combined into one lot. <br /> Commissioner Nosan did not agree with the lot combination. She asked if the 36 foot homes <br /> would be out of place compared to the surrounding 50-foot-deep homes. <br /> Mr. Bona explained that not every home within the neighborhood would be 50 feet deep. He did <br /> not believe there would be a noticeable difference in the homes from the street. He reported 36- <br /> foot-deep homes were being built in Brookfield 6th at this time. He stated again, for the record, <br /> that he would be willing to have covenants approved with the Council to ensure the homes on <br /> Lots 3 and 4 were no more than 36 feet deep. <br /> Commissioner Bauer believed these options were reasonable; however, the City would have no <br /> way of enforcing this requirement. For this reason, he supported the combination of Lots 3 and <br /> 4. <br /> Mr. Bona suggested that the home depth for Lots 3 and 4 be written into the Developer's <br /> Agreement. <br /> Community Development Director Gladhill explained that he could only enforce City Code <br /> within the Development Agreement. He reported the City had no authority to dictate what <br /> housing style was placed on these lots. He believed that the Commission could not rely on a <br /> covenant but rather to support the combination of Lots 3 and 4. <br /> Motion Carried. Voting Yes: Chairperson Levine, Commissioners Bauer, VanScoy, and Brauer. <br /> Voting No: Andrusko and Nosan. Absent: None. <br /> Motion by Commissioner Bauer, seconded by Commissioner VanScoy, to recommend that City <br /> Council adopt Resolution 916-10-188 - Approving Brookfield 8th Addition Preliminary Plat, <br /> combining Lots 3 and 4 into a single lot. <br /> Planning Commission/October 6, 2016 <br /> Page 8 of 13 <br />
