09/22/16 REVISOR CKM/IL AR4240 <br />51.1 A. sustain and enhance the biological and ecological functions of vegetation; <br />51.2 B. preserve the natural character and topography of the Mississippi River <br />51.3 Critical Corridor Area; and <br />51.4 C. maintain stability of bluffs and steep slopes and ensure stability of other <br />51.5 areas prone to erosion. <br />51.6 Subp. 2. Applicability. This part applies to: <br />51.7 A. shore impact zones; <br />51.8 B. areas within 50 feet of a wetland or natural drainage way; <br />51.9 C. bluff impact zones; <br />51.10 D. areas of native plant communities; and <br />51.11 E. significant vegetative stands identified in local governments' adopted plans. <br />51.12 Subp. 3. General provisions. <br />51.13 A. Intensive vegetation clearing is prohibited, except for the following <br />51.14 activities, which are allowed by local permit: <br />51.15 (1) clearing vegetation that is dead, diseased, dying, or hazardous; <br />51.16 (2) clearing to prevent the spread of diseases or insect pests; <br />51.17 <br />(3) <br />removal of invasive non-native species; <br />51.18 (4) restoration and erosion control management activities consistent with a <br />51.19 plan approved by the local government or resource agency; and <br />51.20 (5) the minimum necessary for development that is allowed as an exception <br />51.21 under part 6106.0180. <br />51.22 B.
