10. In tile ..nt that Lessee's operat of a sanitary <br />landfill on the demised premises is, in the I,essee's opinion, <br />substantially restricted, impaired or prevented, or Lessee <br />would be caused, to suffer a substantial economic detriment, <br />during the te~nn he.reof by any governmental body, agency or <br />department having jurisdiction, Lessee shall ]]ave the right <br />to terminate this Lease by Lessee giving Lessor thirty (30) <br />days written notice of such termina'tion. <br /> <br /> 11. In the event the demised premises shall be taken <br /> <br />by, or pursuant to, any gover]~nental authority or through <br />%he exercise of the right of eminent domain; or in the event <br />any part of said demised premises, or any interest therein, <br />i.ncluding but not limited to the right of free access to the <br />demised premises, is so taken or Substantially interferred <br />with and the said demised premises after taking or interference <br />in the opinion of the 'Lessee is not suitable for the operation <br />of~a sanitary landfill, this Lease, at the option of t~e <br />Lessee, shall terminate without 1.lability on the part of <br />Lessee or Lessee may continue in possession of the remaining <br />portion of said demised premises, in which event the rent <br />herein shall be reduced in proportion to the reduction' of <br />the utilizable area of the premises, but nothing herein <br />shall be deemed a waiver of the sole right of Lessee to any <br />award ~or damages to it or a part of a general award. <br />Lessor shall carry out' at its expense any regrading of the <br />premises and approaches thereto necessary to conform the <br />premises to any change in grade of any adjoining streets, <br />alleys or highways. <br /> <br /> <br />
