Under State <br />Law (M.S.A. 238.05 Sub. 7) and Rules (M.C.A.R. Rule 4.226), <br />the Metropolitan Council has ninety days to review and com- <br />ment on the creation of such a service territory within the <br />Metropolitan Area. The M.C.C.B. is scheduled to' act on this <br />proposal at its next meeting?~.May 9, 1980. <br /> <br />A "cable service territory" is defined in the M.C.C.B. Rules <br />as ". . . a geographic area, as may be defined by existing <br />political, metes and bounds, or other appropriate description, <br />which encompasses a cable communications system's entire pro- <br />jected service area." The establishment of a cable service <br />territory is a necessary prerequisite to the issuance by <br />municipalities of any franchises for actual construction and <br />operation of a cable television system. Under State Law and <br />M.C.C.B. Rules, the Metropolitan Council's role is limited to <br />comments and recommendations on the establishment of service <br />territories and does not include any specified role with <br />respect to franchising. <br /> <br /> A cable service territory may be proposed by a municipality, <br /> a group of municipalities or a cable communications operator. <br /> In the case of this proposal, the applicant is a cable commu- <br /> nications operator. Approval of a cable service territory does <br /> not necessarily constitute a presumption that the proposer will <br /> be the successful applicant for one or more franchises within <br /> the territory's boundaries. <br /> <br />Criteria for Metropolitan Council Review <br />M.C.C.B. Rules require that the State Board consider several <br />factors in making a determination on cable service territory <br />proposals: <br /> <br />1. Impact on prospects for development of cable service in <br /> areas within and contiguous to the proposed territory; <br />2. Appropriateness of boundaries; <br /> <br /> <br />
