AGREEMENT <br /> <br /> THIS AGREEMENT made and entered into this 10th day of June, <br />1980, by and between the City of Ramsey, hereinafter called the City, <br />and Donald and Melissa Volner, hereinafter called the Petitioner, <br /> <br /> WHEREAS, the Petitioner has requested a conditional use permit <br />from the City to construct a 240 square foot (maximum) greenhouse at <br />8121 - 154th Avenue N.W., Ramsey, Minnesota, which is legally described <br />as: <br /> <br />LOT 4 BLOCK 13 WHISPERING PINES ESTATES <br /> <br />WHEREAS, said property is to be owned by the Petitioner; and <br /> <br /> WHEREAS, the property is zoned R-1 Single Family Residential, <br />and therefore, no business-type activity may be conducted from the premises, <br />without a special use permit. <br /> <br />l) <br /> <br />NOW THEREFORE, the parties hereto agree as follows: <br /> <br />The Petitioner agrees to comply with the City zoning code for setback <br />requirements; front exterior appearance of the greenhouse structure <br />shall be similar and compatible with the principal structure, and <br /> <br />2) <br /> <br />It is further agreed by the Petitioner that the new greenhouse <br />structure and activity will be used for the purpose of a hobby, <br />and <br /> <br />3) It is hereby agreed by the Petitioners that the new greenhouse facility <br /> will not be used for a retail sales business, and <br /> <br />4) There will be no driveway to the greenhouse facility, and <br /> <br />5) There will be no outside storage of any type pertaining to the green- <br /> house, and <br /> <br />This conditional use permit for this hobby is to be reviewed yearly <br />on the anniversary date of the request being granted, and <br /> <br />In the' event that this activity should become a blight and/or nuisance <br />to the neighborhood or if it in anyway affects the health, safety or <br />welfare of the general public, the City reserves the right to have the <br />structure removed at the property owners expense, and <br /> <br />8) <br /> <br />It is hereby further agreed upon by the Petitioner that he agrees to <br />the following: <br /> <br />a) <br /> <br />Dimensions - That the dimension of the greenhouse will <br />be 12' x 20' The walls will ~e seven (7) feet in height <br />and the center peak of the greenhouse structure will be <br />8' 2". <br /> <br /> <br />
