A~ENDED <br /> PERFORM~qCE OONTRACT BSTH <br /> _"N~E CITY OF RAMSEY <br /> <br /> THIS AG~, made and entered into this day of June, 1980 by and <br /> <br />between the City of Ramsey, located in Anoka County, State of Minnesota, hereinafter <br />referred %o as the "City" and Barthel Homes, Inc., having its principal place of <br />business at 21370 Sesame Street, Rogers, Minnesota 55374, hereinafter referred to as <br />the "Developer." <br /> <br /> I. <br /> <br /> ~3tS, the parties hereto have previously entered into a performance contract <br />relating to the development of the plat known as "Barhhel's Rum River Acres 2nd Addition," <br />said contract bein9 dated October 12, 1979, and <br /> <br /> II. <br /> <br /> ~ERKAS, the F~veloper has nc~ applied to the City 6o extend for one (1) year <br /> <br />the completion date of the blacktop improvements described in Paragraph 2) of the <br /> <br />October 12, 1979 contract, and <br /> <br /> III. <br /> <br /> ~F3~S, the Developer bas now applied to the City for permission to substitute <br />for the letter of credit, required in Paragraph 4) of the October 12, 1979 original <br />contract a second mortgage running to %he CiC~y encumbering the entire plat of "Barthel's <br />Rum River Acres 2nd Addition," said second n~rtgage to be in the amount of Two Hundred <br />Thirty-three Thousand Eight Hundred Fifty and 00/100 ($233,850.00) Dollars, and <br /> <br /> IV. <br /> <br /> K~K~RFAS, in consideration for permitting the amendments described in Paragraphs <br /> <br />II and III above, the Developer agrees bo waive any and all rights it has or may have <br />bo obtain building permits on any of the lots or parcels contained wif_hin "Barthel's <br />Rum River Acres 2nd Addition," with the exception of Lot 1, Block 6 of said plat. <br /> <br /> <br />
