CASE

REQUEST FOR AN INTERIM USE PERMIT FOR A TEMPORARY
OFFICE STRUCTURE; CASE OF TRANSWEST, INC.
By: Megan Wald, Community Development Assistant

Background:

On November 9, 1998, the City issued an interim use permit to Transwest, Inc. at 6100 Industry
Avenue N.W. for the utilization of a temporary office structure on the property for a one-year
period. That permit expired on September 30, 2000. The applicant is asking for a 3rd interim use
permit for the continued lease of the temporary office structure until 2003.

The following items are enclosed for your information:

1. Site location map
2. Structure detail
3. Proposed findings of fact
4. Proposed interim use permit

Notification:

In accordance with State Statutes, notification of the public hearing was sent to persons owning
property within 350 feet of the subject property.

Observations:

In 1997, the City issued an Interim Use Permit for one year for the use of a temporary office
structure. In 1998, the City renewed the permit for another year. Due to the lack of Interim Use Permit language in City
Code, Transwest has been operating absent of a permit since September 30, 2000. The City
recently adopted an Interim Use Permit ordinance and therefore Transwest's application has been
revived.

The City has previously granted permits for the use of temporary office structures for 2 years or
more in the industrial district; most recently those included Listul, Waste Management, and
Amcor.

This site would be significantly enhanced by the placement of additional screening along County
Road #116. The City is suggesting the placement of a berm behind the existing tree line, which
