CASE <br /> <br /> REQUEST TO REZONE CERTAIN PROPERTY FROM <br /> I-INDUSTRIAL TO B-2 BUSINESS; <br />CASE OF THE MENKYELD COMPANY AND CASEY'S GENERAL STORES, INC. <br />By: Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />Casey's General Stores, Inc. and The Menkveld Company .are requesting that the City rezone <br />property at the southwest comer of the intersection of 149~ Avenue N.W. and Ramsey Blvd. <br />N.W. (C.S.A.H. #56) from I-Industrial to B-2 Business to facilitate development of the property <br />with a convenience store with gasoline sales. <br /> <br />Notification: <br /> <br />In accordance with State Statute, City Staff attempted to notify all persons owning property <br />within 350 feet of the Subject Property of the request for rezoning. <br /> <br />Observations: <br /> <br />The subject property is part of a larger parcel that is currently zoned I-Industrial. The property <br />on the north side of 149~ Avenue is zoned R-1 Rural Residential; the adjacent property to the <br />west is zoned Planned Unit Development for single family residential uses with home <br />occupations; the adjacent property to the south is also zoned Industrial and the property on the <br />east side of Ramsey Blvd. is zoned R-1 Urban Residential. <br /> <br />The land use map in the current Comprehensive Plan identifies this area for Industrial uses. The <br />draft Comprehensive Plan dated December 21, 1999, proposes to change the land use to Urban <br />Rural Residential Transition for development with low density housing. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Development Plan <br />Excerpt from Future Land Use Map in the I2/21/99 Comprehensive Plan Draft <br />Proposed findings of fact <br /> <br />Recommendation: <br /> <br />The City has spent a great deal of time reviewing existing and future land uses as part of the <br />process for updating the Comprehensive Plan. Throughout the process, there was no indication <br />that additional commercial uses were desired in the area of this rezoning request and the property <br />was designated for low density residential development. City Staff recommends denial of the <br />proposed rezoning. <br /> <br />Commission Action: <br /> <br />Motion to recommend that City Council adopt Findings of Fact relating to a request from The <br />Menkveld Company and Casey's General Stores to rezone certain property from I~Industrial to <br />B-2 Business. <br /> <br />-and- <br /> <br /> <br />
