CASE # / <br /> <br />REQUEST TO REZONE CERTAIN PROPERTY FROM I-INDUSTRIAL TO B-2 <br />BUSINESS; CASE OF THE MENKVELD COMPANY AND CASEY'S GENERAL <br />STORES, INC. <br /> By: Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />Casey's General Stores, Inc. had applied for a rezoning from I-Industrial to B-2 Business <br />in order to develop a Casey's General Store in the southwest quadrant of the intersection <br />of 149th Avenue N.W. and Ramsey Blvd. N.W. The public hearing regarding the request <br />was scheduled for the regular meeting of the Planning Commission in October. Just prior <br />to the meeting date, City Staff received a call from the Applicants stating that the <br />proposed site layout conflicted with a State setback requirement. Underground fuel tanks <br />are supposed to be at least 300 feet from any residential dwelling and the way the site <br />was laid out in Ramsey, the underground tank was within 300 feet of a home on the north <br />side of 149th. The Applicants requested that their case be tabled until the November <br />meeting to allow them time to assess the situation and possible solutions. <br /> <br />At the October meeting, the Planning Commission called the public hearing to order and <br />at Staff's request, continued the hearing and case to the November agenda. <br /> <br />Observations: <br /> <br />Subsequent to the October meeting of the Planning Commission, Casey's General Stores <br />submitted a letter requesting that their case be withdrawn from consideration.
