CASE #: 7

.PROPOSED ORDINANCE TO AMEND PARK DEDICATION REQUIREMENTS
By: Community Development Director Sylvia Frolik

Background:

Currently City Code requires park dedication in the form of cash or land or a combination'
thereof when property is subdivided.

Observations:

There is the potential for development to occur on property and no subdivision may be required.
For instance, it is possible that there could be a multi-family rental development that would not
require subdivision of the property. Under the current subdivision regulations, the City would
not have the opportunity to obtain park dedication consideration for a high density residential
development.

Bas.ed on conversations with a couple of other communities, Staff has drafted an ordinance that
would require subdivision on all developments, even if subdivision of property is not required.
The draft ordinance is enclosed for your information.

Recommendation:

City Staff recommends that the ordinance be forwarded to Council for adoption.

Commission Action:

Motion to recommend that City Council adopt an ordinance to require park dedication on
development projects that do not require subdivision of land.

Review Checklist:
City Attorney

PC: 12/05/00

95
