Board Member Johnson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04-07-170 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #0681 RELATING TO A REQUEST <br />FOR A VARIANCE TO THE 20 FOOT LANDSCAPE REQUIREMENT ADJACENT TO <br />PUBLIC ROADS. <br /> <br /> WHEREAS, Vern Olson, hereinafter referred to as "Applicant," has properly applied for <br />a variance from Section 9.20.27 regarding landscape requirements adjacent to public roads for a <br />property located at 7039 Hwy. 10 and legally described as follows: <br /> <br />I Jot 2, Block 1, Kovar Addition, Anoka County, Minnesota <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.07 of the <br />Ramsey City Code on July 1, 2004, and that said public hearing was properly advertised, and <br />that the minutes of said public hearing are hereby incorporated as a part of these findings by <br />reference. <br /> <br />2. That the subject property is zoned H-1 Highway 10 Business and is approximately 1 acre in <br /> size. <br /> <br />3. That properties to the east and west are zoned H-1 Hwy. 10 Business. <br /> <br />4. That the property to the north is zoned Town Center (TC-1) <br /> <br />5. That the property to the south is zoned B-2 Highway Business. <br /> <br />6. That section 9.20.27 (Performance Standards, Screening) requires a twenty (20) foot wide <br /> landscaped area adjacent to all public streets. <br /> <br />That the Applicant is requesting a variance from the 20-foot landscape requirement along <br />Highway 10 and placement of a bituminous surface within 10 feet of the property line due to <br />the location of the existing building on the property and the nature of the surrounding uses. <br /> <br />8. That the Applicant has stated the variance requested is the minimum variance needed to <br /> alleviate the hardship. <br /> <br />9. That if granted, the variance will not permit a use that is prohibited in the H-1 Highway 10 <br /> Business District. <br /> <br /> <br />
