Board Member Johnson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION/404-07-172 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #0682 RELATING TO A REQUEST <br />FOR A VARIANCE TO STREET RIGHT OF WAY WIDTH REQUIREMENTS FOR <br />THE RAMSEY TOWN CENTER 4TM ADDITION PLAT. <br /> <br /> WHEREAS, Ramsey Town Center LLC, hereinafter referred to as "Applicant," has <br />properly applied for a variance from Section 9.50.30(3)(a) regarding public street right-of-way <br />width for the Ramsey Town Center 4th Addition and legally described as follows: <br /> <br />Outlot EE, Ramsey Town Center Addition, Anoka County, Minnesota ("Subject <br />Property) <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.05 of the <br />Ramsey City Code on July 1, 2004, and that said public hearing was properly advertised, and <br />that the minutes of said public hearing are hereby incorporated as a part of these findings by <br />reference. <br /> <br />2. That the subject property is zoned TC-2 Town Center Commercial and is approximately 1.23 <br /> acres in size. <br /> <br />3. That properties to the east, west, and south are zoned TC-2 Town Center Commercial. <br /> <br />4. That the property to the north is zoned TC-5 Town Center Park and Open Space. <br /> <br />5. That section 9.50.30(3)(a) [Subdivision Design Standards] requires a sixty (60) foot wide <br /> right-of-way for urban streets. <br /> <br />That the Applicant is requesting a variance from the 60-foot right-of-way width requirement <br />to create a 58-foot wide right-of-way in the Ramsey Town Center 4th Addition plat due to the <br />City's request to shift the proposed building on the plat two feet to the north. <br /> <br />7. That the Applicant has stated the variance requested is the minimum variance needed to <br /> alleviate the hardship. <br /> <br />8. That if granted, the variance will not permit a use that is prohibited in the TC-2 Town Center <br /> Commercial District. <br /> <br />9. That if granted, the variance will not impair an adequate supply of light and air to adjacent <br /> property. <br /> <br /> <br />
