Board Member Johnson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION//04-07-174 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT//0683 RELATING TO A REQUEST <br />FOR A VARIANCE TO THE MAXIMUM FRONT YARD SETBACK FOR THE <br />PROPOSED GROCERY STORE IN THE TOWN CENTER ZONING DISTRICT, <br />SUBDISTRICT TC-2. <br /> <br /> WHEREAS, RAMDANCE, LLC, hereinafter referred to as "Applicant," has properly <br />applied for a variance from Section 9.20.25, Subd. 3.b, regarding minimum and maximum front <br />yard setbacks in the TC-2 sub-district of the Town Center District, on the property legally <br />described as follows: <br /> <br />Outlot I, Ramsey Town Center Addition, Anoka County, Minnesota ("Subject <br />Property) <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.07 of the <br />Ramsey City Code on July 12, 2004, and that said public hearing was properly advertised, <br />and that the minutes of said public hearing are hereby incorporated as a part of these findings <br />by reference. <br /> <br />2. That the Subject Property is zoned TC-2 Town Center Commercial and is approximately 9 <br /> acres in size. <br /> <br />3. That properties to the east, west, and north are zoned TC-2 Town Center Commercial. <br /> <br />4. That the Subject Property is bounded on the south by the Burlington Northern Santa Fe <br /> Railroad. <br /> <br />5. That section 9.20.25, Subd. 3.b, establishes a minimum front yard setback of 0 feet and a <br /> maximum structure setback of 15 feet. <br /> <br />That the Applicant is requesting a variance from the 15 foot maximum front yard setback in <br />order to construct a grocery store on the Subject Property that will be located approximately <br />300 feet from the front property line. <br /> <br />7. That the Applicant has stated the variance requested is the minimum variance needed to <br /> alleviate the hardship. <br /> <br /> <br />
