Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04-07-181 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0684 RELATING TO A <br />REQUEST FOR A CONDITIONAL USE PERMIT FROM JAMES AND DIANA <br />FEIGUM TO EXCEED SIZE RESTRICTIONS FOR ACCESSORY BUILDING SPACE <br />ON A PROPERTY RANGING IN SIZE FROM 1 TO 1.99 ACRES. <br /> <br /> WHEREAS, James and Diana Feigum, hereinafter referred to as the "Applicants", have <br />properly applied for a Conditional Use Permit to exceed the maximum amount of square feet for <br />accessory buildings on properties from 1 to 1.99 acres as established in section 9.11.02 <br />"Accessory Uses" of City Code on the property generally known as 6321 163rd Lane NW and <br />legally described as follows: <br /> <br />Lot 5, Block 3, Menkvelds Country Park, Anoka County, Minnesota <br /> <br />("Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />That the Applicants appeared before the Planning Commission for a public hearing pursuant <br />to Section 9.03.04 of the Ramsey City Code on July 1, 2004, and that said public hearing was <br />properly advertised and that the minutes of said public hearing are hereby incorporated by <br />reference. <br /> <br />2. That the Subject Property is zoned R-1 Residential - Rural Developing and is located outside <br /> the Metropolitan Urban Service Area (MUSA). <br /> <br />3. That the Subject Property is surrounded by properties also zoned R-1 Residential-Rural <br /> Developing. <br /> <br />4. That the Subject Property is approximately 1.2 acres in size. <br /> <br />5. That City Code restricts the Subject Property to a total of 1,664 square feet of accessory <br /> building space. <br /> <br />That the Applicants have a primary garage of 624 square feet; the new accessory building is <br />proposed to be 1,320 square feet in size; resulting in a total of 1,944 square feet of accessory <br />building on the Subject Property and an overage of 280 square feet of accessory building <br />space. <br /> <br />That the Applicants have stated that the reason for the excess size of the proposed building is <br />to store private-use vehicles, equipment and other personal property, which is currently either <br />stored outside on the property or off-site. <br /> <br /> <br />
