Councilmember Pearson introduced the following resolution and moved for its adoption: RESOLUTION #04-07-197 A RESOLUTION ADOPTING FINDINGS OF FACT #0688 RELATING TO A REQUEST FOR A CONDITIONAL USE PERMIT TO CONSTRUCT A BUILDING LARGER THAN 35,000 SQURE FEET IN THE TC-2 ZONING DISTRICT WHEREAS, Ramdance LLC, hereinafter referred to as the "Applicant," has properly applied for a Conditional Use Permit to construct a building larger than 35,000 square feet in the TC-2 Zoning District on property legally described as follows: Outlot I, Ramsey Town Center Addition, Anoka County, Minnesota ("Subject Property") NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the request are determined to be as follows: That the Applicant appeared before the Planning Commission for a public hearing pursuant to Ramsey City Code on July 12, 2004, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated by reference. 2. That the Applicant has submitted a site plan to construct a 54,000 square-foot grocery store within the Ramsey Town Center development. 3. That the Applicant has indicated that the grocery store may be expanded to 63,000 square feet in the future. 4. That the Subject Property is approximately nine acres in size. 5. That the Ramsey City Council adopted the Town Center Zoning District on September 23, 2003. 6. That the Subject Property is zoned TC-2 and is located inside the urban service area. (MUSA). 7. That the TC-2 Zoning District states that buildings larger than 35,000 square feet are only permitted as a conditional use within the District. 8. That the City has reviewed the size of the building and finds that the size and use of the drive-thru is compatible with the intent of the Ramsey Town Center development. 9. That the proposed use will not adversely impact traffic in the area.
