Development Contract <br /> <br />Yesterday, at the request of the builder, I inspected the above <br />referenced property for compliance with their development contract <br />dated October 22, 1979. The building has been completed and the <br />parking lot has been striped. However~ the new three foot sidewalk <br />and two foot sod area have not been installed. (See attached copy <br />of site plan.) The developer has put in shrubs aroand the building <br />which are in planters and are not permanently planted, as such. <br /> <br />The developer has indicated that, in his opinion, he has complied <br />with the development contract and has requested his $1,100 escrow <br />be refunded. <br /> <br />Although, the improvements made to date have greatly improved the <br />appearance of the property, it is my opinion that the construction <br />does not totally comply with the development contract inasmuch as <br />the sidewalk and sod area for shrubs have not been installed. <br /> <br />Perhaps the City Council should consider this matter. <br />CRB: sb <br /> <br /> <br />
