-2- <br /> <br />An amendment to NR 2700 would require a public hearing under M.S. § 15.0412 <br />presided over by the State Office of Hearing Examiners. The City would have <br />to petition for such an amendment pursuant to M.S. ~ 15.0415 and justify the <br />need and reasonableness of such an amendment. Such actions would require much <br />time and expense for the City and the State. <br /> <br />COMMENTS ON PROPOSED SCENIC RIVER ORDINANCE: <br /> <br />1) <br /> <br />Section 170.076.110. The third set of astericks after this section (***) <br />does not contain the correct cross-reference. The following cross-reference <br />mus~ be ad~ed: "170.076.13." <br /> <br />2) Section 170.076.28 and 170.076.33. Insert the correct cross-reference: <br /> "170.0710.1." <br /> <br />3) Section 170.0711.41. NR 81(d) refers to all final plats being sent to the <br /> Commissioner within 10 days after approval by the local authority. <br /> <br />4) Section 170.0711.71. The cross-reference should be Section 170.076 not <br /> 170.077.6. <br /> <br />5) <br /> <br />Section 170.0711.72(1). A copy of all notices or applications to consider <br />conditional uses as specified in Section 170.075.22 and 170.075.27 must <br />also be sent to the Commissioner within 30 days prior to consideration of <br />the action. Also a copy of proposed recreational plan must be submitted <br />with the notice or application. <br /> <br />6) <br /> <br />Section 170.0711.72(4) Those recreational uses that require certification <br />as specified in NR 2720A(4)(e) as specified in NR 79(b)(2)(aa), (bb), (cc), <br />(dd), (fl), and (gg) should be listed in this Section or following this~ <br />Section. <br /> <br />COMMENTS ON THE COMPREHENSIVE PLAN: <br /> <br />The major area of contention with the comprehensive plan is in regards to the <br />proposed dimensional standards and conflicts with required shoreland and wild <br />and scenic standards. <br /> <br />l) <br /> <br />Page 30. The lot size requirements in Table 3 for unsewered non-riparian <br />lots is listed as 20,000 square feet for NE shoreland, 15,000 square feet <br />for RD shoreland, and 10,000 square feet for GD.shoreland. The municipal <br />shoreland standards in NR 83 for unsewered non-riparian lots requires the <br />same dimensional standards as for riparian non-sewered lots, i.e. 80,000 <br />square feet for NE; 40,000 square feet for RD shoreland; and 20,000 square <br />feet for GD shoreland. <br /> <br />2) <br /> <br />Page 33. Table 8 lists 75 feet for building setbacks from the ordinary <br />high water mark for unsewered lots along the Mississippi River instead <br />of the required 100-foot setback. The 100-foot setback is also required <br />for the sewered riparian and non-riparian lots. Also the setback for <br />controlled vegetative cutting is lO0 feet. <br /> <br /> <br />
