-!8- <br /> <br />Metropolitan Waste Control Commission (MWCC) Facilities <br />[Sections 3-5] <br /> <br />1. Siting Procedure. A procedure for establishing <br />facilities for the disposal of the solid waste and <br />sewage sludge of the MWCC is 'established. <br /> <br />By July, 1981, the Council must select six candidate <br />sites, plus buffer areas, for MWCC facilities, in <br />accordance with statutory standards. The PCA must <br />certify the suitability of each site for the use <br />intended, based on preliminary environmental analysis. <br />A moratorium is imposed on development at the candidate <br />sites until six months following final site selection <br />by the Council. <br /> <br />within 280 days following 'the identification of <br />candidate sites, an EIS must be completed on all six of <br />the sites. Within 90 days of acceptance of the-EI$, <br />the PCA must indicate the conditions and terms of all <br />permits needed at each of the sites. Within 90 days of <br />the PCA decision on permits, the Council must select at <br />least one site for sewage sludge and one for solid <br />waste disposal. <br /> <br />2. MWCC Sludge Disoosal. The MWCC is authorized to <br />use sludge as a soil conditioner on private property <br />and, for an interim period no longer than four years, <br />on its own property. All sewage sludge disposal <br />facilities and sites will be required to have a PCA <br />permit and to be regularly monitored by the MWCC and <br />inspected by the PCA. <br /> <br />3. MWCC Solid Waste Disposal. The MWCC is authorized <br />to continue using existing facilities for disposal of <br />its solid waste for an interim period no longer than <br />four years. The MWCC also is eligible to petition the <br />WMB, under Article IV, for supplementary review of a <br />proposal for a temporary ~iWCC solid waste disposal <br />facility. <br /> <br />Local Restrictions. [Sections 5, 9] <br /> <br />Waste facilities and sites established in accordance <br />with the Act are exempted from local prohibitions. <br />Local jurisdictions may, however, impose reasonable <br />restrictions on construction, operation, and use, <br />subject to approval by the Metropolitan Council and the <br />PCA. <br /> <br /> <br />
