EXCEPTIONS from all the above described parcels the follow- <br />ing platted lots: <br /> <br />Lots 1 - 6 Block 1 <br />Lots 1 - 3 Block 2 <br />Lots 1 - 8 Block 3 <br />All in Alpaca Estates.Section Addition, and <br /> <br />Lots 1 and 2 Block 3 <br />Lots 1 and 2 Block 4 <br />Lots 5 and 6 Block 2 <br />Lots 5 and 6 Block 5 <br />Ail in Alpaca Estates <br /> <br />The purpose of said mortgage is to guarantee that the Developer will comply <br />with all of the requirements as set forth aforesaid and the installation of <br />all said improvements in a good .and workmanshiplike manner, pursuant to the <br />plans and specifications and requirements of the City Engineer. <br /> <br /> 4) Further, the Developer shall pay to the City all expenses <br />of the City for the preparation of any plans and specifications for the <br />said improvements, and that said payment shall be made to the City in ad- <br />vance based upon the City cost estimates of the City Engineer. The said <br />payment shall also include the inspection costs of the City for its costs <br />in inspecting the construction of the aforesaid improvements by the City <br />Engineer. The Developer shall also pay to the City any legal expenses in- <br />curred which relate to the required improvements. <br /> <br /> '5) IT IS FURTHER AGREED, that should any of the terms of this <br />agreement fail to be performed by the Developer in the time permitted herein, <br />or in the manner required by the City Code and the City Engineer, that the <br />City shall be entitled to foreclosure on the above described mortgage and <br />obtain funds to complete the improvements as described herein. <br /> <br /> 6.) That in the event the mortgage is foreclosed and the City <br />constructs or completes all of the required acts as set forth aforesaid and <br />the City finds that the cost of such improvements exceeds the amount ob- <br />tained from the foreclosure, the remaining balance of said costs can and <br />shall be assessed against all of the property in the said plats including <br />all of the lots and blocks in Alpaca Estates Second Addition and Lots 1 and <br />2 Block 3, Lots 1 and 2 Block 4, Lots 5 and 6 Block 2 and Lots 5 and 6 <br />Block 5 all in Alpaca Estates. <br /> <br /> CITY OF RAMSEY <br /> <br />ATTEST: <br /> <br />Mayor <br /> <br />City Administrator/Clerk <br /> <br />ALPACA ESTATES, a partnership <br /> <br />Hakans I.
