I~cation of property: Lot 9, Block 2, and Outlot A, Block 2 of Carol Rose <br />Acres. <br /> <br />Mr. Duncan Johnson was present and reviewedhisproposal with the Council. <br /> <br />~tJon #1 was recommended to be disregarded by the City Engineer, Pete Raatikka. <br /> <br />Mr. Johnson said that he wants to give land to his brother so. he can~build a <br />house and that there is some question to the frontage meeting the requirements and <br />that is why he presented the two options. <br /> <br />Engineer Raatikka stated in his report that even to meet regulations, Option <br />#2 would mean moving the lot line of Lot 9 at least 45 feet north because <br />he doesn't meet 2½ acres area requirements. <br /> <br />Mr. Johnson stated that when he originally built his home he could have <br />placed his home on the other side of the lot fromwhere it is and therefore <br />he feels that there should be no reason that the property to the west would <br />be unbuildable now. <br /> <br />Ben Deemer explained that he could have placed his house in other locations <br />on the lot so that he could have a chance to future subdivide when and if <br />sewer is available. ~ir. Deemer also pointed out that Mr. Johnson i~ in <br />fact asking for a subdivision to create three lots. <br /> <br />Gerald Zimmerman abstained on this issue because he lives in the area. <br /> <br />Chairman Peterson questioned why Mr. Johnson could not make it just two <br />lots instead of three, in fact there would be no reason why he couldn't <br />leave his lots just the way they are and apply for a' building permit <br />for the northeasterly corner of the outlot, if it would meet the soil <br />conditions for septic systems etc. It was further explained to Mr. Johnson <br />that if the Outlot A-lot could not meet the soil conditions then the <br />proposed lot shown in Option #2 would not me~t the soil condition requirements <br />either. Mr. Johnson was informed that he could seek a building permit from <br />the City building official and just drop the platting proposal. <br /> <br />M~.Johnson concurred with this suggestion and stated that he was under the <br />impression that he could not build on an' outlot. <br /> <br />Chairn~n Peterson further stated that he could give Outlot A to his <br />brother with some sort of an agreement between the two of them that if sewer <br />does go through someday, that part of the outlot would belong to Mr. Johnson <br />and he should have an attorney draw up the proper legal documents to cover his <br />interest in the land. <br /> <br />Chairman Peterson cancelled the Workshop meeting for the month of December. <br /> <br />Mayor Gamec was present at the meeting and reported the status of the <br />sanitary sewer trunk line connection to the P & Z Commission. <br /> <br /> P&Z <br />Regular Meet:ing - 12/5/79 <br /> <br />Page 2 <br /> <br /> <br />
