DEVELOPMENT CONTRACT - BURR OAK INDUSTRIAL PARK <br /> <br /> THIS AGREEI~ENT, made and entered into on the date specified herein, by and <br />between the City of Blaine, a municipal corporation of the State of Minnesota <br />(hereinafter called the ."City") and Good Value Homes, the owners and subdivicler$ <br />(hereinafter called the "Developer") identified in paragraph 14 herein. <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, the Developer is the owner of the following described property <br />situated in the City of Blaine, County of Anoka, State of Minnesota' <br /> <br />BURR OAK INDUSTRIAL PARK <br /> <br /> WHEREAS, the City has approved said plat, described as Burr Oak Industrial <br />Park, and <br /> <br /> WHEREAS, the Developer has submitted a petition to the City requesting the <br />construction of improvements in the above described area as follows: <br /> <br />SANITARY SEWER, STORM DRAINAGE FACILITES, WATERMAIN AND APPURTENANCES AND <br />STREET CONSTRUCTION <br /> <br /> WHEREAS, the City has reviewed and accepted a feasibility report of <br />Consulting Engineers Diversified, Inc., and has ordered the preparation of final <br />plans and specifications for the requested improvements,.and <br /> <br /> WHEREAS, the City has advertised for bids for the construction of said im- <br />provements affecting the plat and will award a contract for the construction of <br />said improvements to the lowest responsible bidder, and <br /> <br />WHEREAS, the City ordinance requires park dedication payment of $16,688.00 <br /> <br />NOW, THEREFORE the City and the Developer agree as follows: <br /> <br />That the recitals above and the provisions of the subdivision ordinance of <br />the City, amended to date hereof, are incorporated hePein by reference. <br /> <br />The City agrees to construct the requested improvements according to the <br />terms and conditions of thi's contract. <br /> <br />The Developer will pay a cash park dedication fee.of $16,688.00 before the <br />final plat is released to the Developer and the City agrees to accept s~id <br />payment in lieu of park dedication. <br /> <br /> The City agrees to finance the cost of construction of said improvements made <br /> <br />· . by the City'and the City will advertise for bids for the construction of said <br /> - improvements and will award a contract for the construction of said improve- <br /> ments to the lowest responsible bidder. <br /> <br />-1 - <br /> <br /> <br />
