CITY OF RAMSEY <br /> CITY COUNCIL <br />FINDINGS OF FACT REGARDING MICHAEL WIDHALM <br />BOARD OF ADJUSTAIENT VARIANCE <br /> <br />1) That the Applicant has properly applied for a Board of Adjustment <br />variance for an accessory building. <br /> <br />2) That the Applicant appeared before the Board of Adjustment for a public <br />hearing on August 26, 1980, said public hearing was properly advertised <br />and the minutes of that public hearing are hereby incorporated as a part of <br />'these findings by reference. <br /> <br />3) That there are exceptional and unique circumstances that apply to <br />this property that do not generally apply to other properties in this <br />zoning district inasmuch as most properties do have attached garages and <br />this property does not. <br /> <br />4) That such a variance is necessary for a substantial property right <br />similar to that possessed by other properties as other properties could <br />conceivably construct accessory buildings (attached/detached) to a total <br />area of 1,488 square feet. <br /> <br />5) That the authorization of this variance will not be a detriment to <br />adjacent properties and will not impair the intent of this ordinance or <br />the public interest. <br /> <br />6) That the condition or situation of this specific piece of property is <br />not so general in nature as to make reasonably practicable the formulation <br />of a general regulation governing such conditions or situations. <br /> <br />7) That this variance observes the spirit and intent of this ordinance, <br />produces substantial justice and is not contrary to the public interest <br />inasmuch as the total area of his proposed accessory building is less <br />than the aggregate total allowed by ordinance. <br /> <br /> <br />
