- 43 - <br /> <br />Sec. 473.833, Subd. 3. Each metropolitan county shall establish <br />a site selection authority. By June 1, 1983, each site selection <br />authority shall select specific sites within the county from the <br />Council's disposal site inventory, in accordance with the proce- <br />dures established by the Council under Section 473.149, Subdivi- <br />sion 2e, and in a number equal to that required by the Council to <br />be acquired by the county. Each site selection authority shall <br />be composed of the county board, plus one member appointed by the <br />governing body of each city or town within the county containing <br />a site in the Councils' disposal site inventory or the majority <br />of the land containing within such a site. If the number of <br />members on the site selection authority who reside in a city or <br />town contain all or part of a site or buffer area is equal to or <br />greater than the number of members who do not, the chairman of <br />the county board shall appoint to the authority an additional <br />member or members, residing within the county but not within a <br />city or town containing all or part of a site or buffer area, <br />sufficient to assure a majority of one on the authority of <br />members residing in cities and towns not containing all or any <br />part of a site of buffer area. The chairman of the county board <br />shall be the chairman of the site selection authority. If a site <br />selection authority, has not selected the reauisite number of <br />sites in accordance with the Council's standards, criteria, and <br />procedures by June 1, 1983, the Council shall make the selection. <br /> <br />Planning Step Number 7: County Acauisition of Disposal Sites <br /> <br />Sec. 473.833, Subd. 4. In order to prevent the development of <br />conflicting land uses at and around future solid waste disposal <br />facility sites, the Council shall provide for the acquisition by <br />a metropolitan county of property and rights in property at and <br />around each solid waste disposal site selected pursuant to Sub- <br />division 3. Each site scheduled for development as a facility <br />through the year 1990 shall be acquired in fee. Development <br />rights shall be acquired for each site scheduled for development <br />as a facility after the year 1990 through the year 2000. Develop- <br />ment rights shall be acquired in a buffer area surrounding and at <br />least equal to the area of each site scheduled for development as <br />a facility through the year 2000. The owner of any property'for <br />which development rights are to be or have been acquired pursuant <br />to this subdivision may elect by written notice at any time up to <br />90 days following the issuance of a permit by the agency for a <br />facility to have the county acquire fee title to the property. <br />Fee title shall be acquired by counties for buffer areas only at <br />the election of the owner of the fee. <br /> <br /> <br />
