CASE # 5 REQUEST TO VACATE A PORTION OF A DR~AGE AND UTILITY EASEMENT ON LOT 2, BLOCK 1, HAUSER ADDITION (WISER CHOICE LIQUOR); CASE OF M & W HOLDING LLC By: Patrick Trndgeon, AICP Assistant Community Development Director Background: Lot 2, Block 1, Hauser Addition currently has standard drainage and utility easements around the perimeter of the lot. The parcel is located at 14590 Armstrong Blvd. and presently occuPied by Wiser Choice Liquor Store. M&W Holding LLC has site plan approval for an expansion of the liquor store that would encroach in the drainage and utility easement along the southern property line. The applicant has asked that the drainage and utility easement along the southern property line be vacated in order to allow for the expansion. The fbllowing items are enclosed for your information: a) Site Location Map b) Exhibit of underlying easements to be vacated c) Proposed ordinance Public Notice: Tile public hearing was pt:operly notified in the Anoka County Union as required under State Statute. Observations: A public hearing was held at the August 24, 2004 City Council meeting. No comments were received. At that meeting, the City Council introduced the ordinance to vacate the drainage and utility, easement for Lot 2, Block 1, Hauser Addition. Recommendation: Pursuant to the City Charter, the ordinance is now eligible for adoption. City, Staff recommends adoption of the enclosed ordinance to vacate a portion of the existing easement on Lot 2, Block 1, Hauser Addition. Council Action: Motion to adopt Ordinance #04-08__ to vacate the drainage and utility easement along the southern lot line of Lot 2, Block l, Hauser Addition. Review Checklist: Asst.
