Councihnember introduced the following resolution and moved for its adoption: RESOLUTION # 04-09- A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERNIIT TO MICHAEL METTLER TO EXCEED THE MAXIMUM SQUARE FOOTAGE ALLOWED FOIl ACCESSORY STRUCTURES BASED ON FINDINGS OF FACT # AND .. DECLARING TERMS OF SAME: WHEREAS, Michael Merrier (Permittee) has properly applied for a Conditional Use Permit to exceed the maximum square footage allowed for accessory buildings for properties between 1- and 1.99 acres as established in section .9.11.02 (Accessory Uses) of City Code. on the property generally known as 1531 $ Sunfish Lake Blvd NW and legally described as follows: The south 194.5 feet of that part of the Southwest Quarter of the Northwest Quarter of Section 23, Township 32, Range 25, Anoka County, Minnesota lying easterly of the centerline of County State Aid HighWay Number 57. Excluding road and subject to easements of record. (Subject Property) WHEREAS, the Planning Commission met on September 2, 2004, conducted the public hearing and recommended City Council approval of the request; NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOIC4 COUNTY, STATE OF MINNESOTA, as follows: Based on Findings of Fact # , a Conditional Use Permit (Permit) to exceed the maximum allowable square fbotage for accessory building 'space on properties between 1 and 1.99 acres in size is hereby granted to Michael Mettler, hereinafter referred to as the "Permittee".' That thc overall square footage for accessory buildings may exceed the 1,.664 square foot accessory building size restriction for, properties between 1 and 1.99 acres by a total of 264 square feet in order to accommodate the inside storage of private-use equipment and Vehicles. 3. That the construction of the addition on the detached accessory building on the Subject Property shall req~:tire issuance of a building permit from the City of Ramsey. 4. That the accessory building shall be properly constructed and maintained in accordance with ali applicable International Building Codes. 5. The Permittee herein agrees that no business use will be operated in the detached accessory building unless such use is permitted in accordance with the City Code. Thc Permittee herein agrees to allow Staff to inspect the site within thirty (30) days of the final inspection of the addition to verify that off-street parking and condition of premises violations have been resolved.
