Councihnember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION # 04-09- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO <br />ERIC THOMSEN TO EXCEED THE MAXIMUM SQUARE FOOTAGE ALLOWED FOR <br />ACCESSORY STRUCTURES BASED ON FINDINGS OF FACT # AND DECLARING <br />TERMS OF SAME: <br /> <br /> WHEREAS, Eric Thomsen (Permittee) has properly applied for a Conditional Use Permit to <br />exceed the maximum square footage allowed for accessory buildings for properties that are 10.6 <br />acres or greater in size as established in section 9.11.02 (Accessory Uses) of City Code on the <br />property generally known as 6210 Green Valley Road NW and legally described as follows: <br /> <br />The Northwest Quarter of the Southwest Quarter of Section 2, Township 32, Range <br />25, Anoka County, Minnesota, lying south of Anoka County Road No. 63 <br /> <br />(Subject Property) <br /> <br /> WHEREAS, the Plmming Commission met on September 2, 2004, conducted the <br />public hearing and recommended City Council approval of the request; <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE .CITY <br />OF I~4MSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact # , a Conditional Use permit (permit) to exceed the maximum <br />allowable square footage for accessory building space on properties 10.6 acres or greater in size <br />is hereby granted to Eric Thomsen, hereinafter referred to as the "Permit-tee". <br /> <br />That the overall square tbotage for accessory buildings may exceed the 5,664 square foot <br />accessory building size restriction Ibr properties 10.6 acres or greater in size by a total of 5,546 <br />square fizet in order to accommodate inside storage of machinery, grain, and hay. <br /> <br />3. That the accessory building shall be properly constructed and maintained in accordance with all <br /> applicable International Building Codes. <br /> <br />4. The Permittee herein agrees that no business use will be operated in the detached accessory <br /> building unless such use is permitted in accordance with the City Code.. <br /> <br />5. That this Permit shall be perpetual in duration as long as the terms are herein complied-with. <br /> <br />6. That the Permittee shall be responsible for all City costs incurred in administering and enfbrcing <br /> this Permit. <br /> <br />7. That the City Administrator, or his/her designee, shall have the right to inspect t.he premises for <br /> compliance and safety purposes ammally or at any time, upon reasonable request. <br /> <br />That this Permit shall automatically expire if construction has not commenced by September 13, <br />20O5. <br /> -287- <br /> <br /> <br />
