Conncilmember Zimmerman commented this is a good use of the City Stormwater Utility Fund.
If this amount was added to this local problem it ~vould really be a burden on ttie homeowners in
that area.

Assistant Public Works Director Olson indicated the Shumway case discussed earlier is another
example of the reason for the Stormwater Utility Fund. There is a need to get drainage onto
some of these streets and to maintain a good road system.

Motion by Councilmember Elvig, second by Councilmember Cook, to approve Resolution #04-
08-218 awarding Project #04-24 Helium Street/169th Avenue Drainage project to Perm
Contracting, h~c. in the amount of $66,240.

Motion can'ied. Voting Yes: Mayor Gamec, Councilmembers Elvig, Cook, Kurak, Strommen,
and Zimmerman. Voting No: None. Absent: CouncilmemberPearson.

Case #8:

Request for Final Plat Review of Alpine Acres 3''a Addition; Case of Oak
Creel< Builders

Community Development Director Frolik indicated Oak Creek Builders has applied for final plat
approval of Alpine Acres yd Addition. This final plat conforms to the preliminary plat. Park
dedication, trail fees, and storm water management fees for the third phase will consist of a cash
payment. She noted the City recently established an ordinance adopting MN State Building Code
Amendment 1306. A portion of the amendment requires residential dwelling structures over
8,500 square feet in size to install a fire spri~zkler suppression system. In the case of Alpine
Acr'es Ya Addition, a significant portion of the streets and infrastructure is already constructed
within the third addition. In order for Alpine Acres 3rd Addition to comply with 1306, the
existing streets will have to be removed, infrastruc{ure resized, and streets reconstructed. Staff
does not see the advantage of disturbing existing streets and infrastructure; therefore, in
situations where a residential structure is located adjacent to existing streets and infrastructure
that was installed prior to July 23, 2004, staff suggests that the City waive the amended 1306
compliance requirement. She advised staff recommends final plat'approval of Alpine Acres 3''d
Addition, waiving the requirement of the fire suppression equipment, but would like to reserve
the right to verify the trail construction credit due in item #19 of the development agreement with
the Engineering Department.

Councilmember Zimmennan asked if a future homeowner could put in the fire suppression by
themselves.

Public Works Director Kapler replied every home could do that. The issue was with the
infrastructure in the street; the stub size is too small and staff thought it would be an undue
burden to tear. up the street and redo the water. He explained each unit could do this on their own
if they would like.

Councilmember Cook noted there are ways to do this without using City water pressure.

-46-

City Council/August 10, 2004
