Case #9: <br /> <br />Request for Final Plat Review of Alpine Acres 4th'Addition Case of Oak <br />Creek Builders <br /> <br />Community Development Director Frolik advised Oak Creek Builders has applied for final plat <br />approval of Alpine Acres 4th Addition. This has the same situation with the fire sprinkler <br />suppression system; however, Alpine Acres 4th Addition contains 16 units where streets and <br />infrastructure has not been installed to date. Compliance with amendment 1306 is a transitional <br />period and b~st efforts should be made to comply with the fire sprinkler suppression requirement, <br />however, due to the fact that only eight percent of the development has the potential to be <br />serviced by fire sprinkler suppression, staff is recommending that the City waive the fire <br />suppression requirement in this case. Park dedication, trail, and storm water would be a cash <br />payment. There is a correction to the development agreement with trail fees due at $23,100. As <br />in the previous case staff would like to reserve the right to verify the trail const~n,tction credit due <br />in item # 19 of the development agreement with the Engineering Department. <br /> <br />Councihnember Elvig inquired about the setbacks in this area. He noted they had negotiated to <br />have them set back in Phase 2, and they appear to be out on the road in this plat. <br /> <br />Assistant Public Works Director Olson explained this is what was negotiated at the time of <br />preliminary plat. To shift a building pad they x. vould have to ask them to change the preliminary <br />plat and the grading plan. <br /> <br />Councihnember Elvig asked how far the setback is. <br /> <br />Community Development Director Frolik replied the setback is at 42 feet; the minimum is 30 <br />feet. <br /> <br />Councihnember Strommen inquired about lots 8, 9 and 10, which seem to overlap with the <br />delineated wetland. <br /> <br />Assistant Public Works Director Otson replied he believes the developer has received a WMO <br />permit. It may have been that there will still be a drainage and utility easement even though the <br />lots are being platted. If they are infringing it would be less ~than the minimum amount and it <br />will not require mitigation. He recalls that was an issue and can double check that. He advised <br />this final plat is substantially in conforlnance with the preliminary plat that was approved and <br />suggested a motion be made to witl~aold the b.uilding permit for lots 8 tlxrough 10 on Block 2 <br />until it is verified that the wetland issue has been resolved. <br /> <br />Motion by Councilmember Cook, second by Councilmember Elvig, to adopt Resolution #04-08- <br />220 approving the final plat of Alpine Acres 4t}~ Addition contingent upon compliance with City <br />Staff Review Letter dated July 23, 2004 and the Developer entering into a Development <br />Agreement with the City, waiving the requirement of the fire suppression equipment, reserving <br />the right to verify the trail construction credit due in item #19 of the development agreement xvith <br />the Engineering Department, and withholding the building permit for lots 8 tl2'ough I0 on Block <br />2 until it is verified that the wetland issue has been resolved. <br /> <br />-48- <br /> <br />City Council/August 10, 2004 <br /> Page 24 of 27 <br /> <br /> <br />
