Landings or takeoffs of an aircraft of a governmental agency operating in <br />its official capacity; or <br />Landings or takeoffs which the City is pre-empted from regulating. <br /> <br />9.16.04 Heliport Permits. <br /> <br />The Permit for a Personal Use Heliport may be issued if the City Council <br />makes the following findings: <br /> <br />2. <br />3. <br />4. <br /> <br />Noise levels comply with Minnesota Rules Chapter 7030. <br />That the aircraft operator is licensed to the extent required by FAA. <br />The use heliport is licensed by Mn/DOT Office of Aeronautics. <br />In the event the applicant for the Permit does not own the property <br />on which the heliport is proposed to be sited, the applicant must <br />provide the City with evidence of written permission from the <br />property owner to land or takeoff; for lands owned by the City, the <br />written permission of the City Council shall be required. <br />That persons or property will not be unduly endangered as a result <br />of the landings or takeoffs. Among the factors to be considered are <br />the location and size of the proposed landing/takeoff site, <br />surrounding land uses and structures (such as buildings, power <br />poles, signs, or fences), existing terrain and foliage, numbers of <br />persons expected to be at or about the site, and flight paths to or <br />from the site. <br /> <br />Co <br /> <br />If granted, the terms of the Permit shall include but not be limited to the <br />following items: <br /> <br /> Requirement Zoning District <br /> R1,2,3 BI,2,3; Hi El, 2 <br />Minimum Lot Size 3 acres None None <br />Minimum Altitude Over Structures and People 500 500 500 <br />Permitted Takeoff/Landing Hours 8:00 a.m.- Sunset 7:00 a.m. - Sunset 24 Hours a day <br />Frequency Restriction On Landings and Takeoffs 1/6 hours 1/4 hours None <br />Heliport Marking and * Yes Yes Yes <br />Liability Insurance** Yes Yes Yes <br /> <br />* Liability Insurance and Liability Indemnification. The Permit Holder <br />shall secure and maintain insurance from an insurance company acceptable <br />to the City and authorized to write casualty insurance in the State of <br />Minnesota which will protect the Permit Holder, its agents and employees <br />and the City from claims for bodily injury, death or property damage which <br />may arise from the operations on the Subject Property. The Permit Holder <br />shall file a certificate of insurance or a certified copy of the insurance <br />policy with the City. Such insurance policy shall contain a clause <br />providing that it shall not be cancelled by the insurance company without <br />thirty (30) days' written notice to the City of intention to cancel.
