Case #5: Request to Vacate a Portion of a Drainage and Utility Easement on Lot 2, <br /> Block 1, Hauser Addition (Wiser Choice Liquor); Case of M&W Holding <br /> LLC <br />Assistant Commmfity Development Director Trudgeon advised a public hearing was held at the <br />August 24, 2004 City Council meeting regarding the vacation of a portion of a drainage and <br />utility casement on Lot 2, ]Block 1, Hauser Addition £0r Wiser Choice Liquor. No comments <br />were received. At that meeting, the City Council introduced the ordinance to vacate the drainage <br />and utility casement for Lot 2, Block 1, Hauser Addition. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Cook, to adopt Ordinance #04- <br />39 to wtcate the drainage and utility easement along the southern lot line of Lot 2, Block 1, <br />Hauser Addition. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Mayor Gamcc: aye <br />Cotmcihnember Cook: aye <br />Councihnember Elvig: aye <br />Councihnember Kurak: aye <br />Counci hnember Pearson: aye <br />Councilmember Strommen: aye <br />Councilmember Zimmerman: aye <br /> <br />Motion carried. <br /> <br />Case #6: <br /> <br />Request for a Conditional Use Permit to Exceed the Allotted Square Footage <br />for Accessory Buildings; Case of Michael Mettler <br /> <br />Assistant Community Development Director Trudgeon explained the City has received an <br />application from Michael Mettler for a Conditional Use Permit to exceed the maximum <br />allowable square footage for accessory buildings on properties between-1 and 1.99 acres as <br />established in City Code on the property located at 15315 Sunfish Lake Boulevard NW. The <br />property is approximately 1.73 acres in size and is located inside the Metropolitan Urban Se~wice <br />Area (MUSA). According to City Code, the property is eligible for 1,664 square feet of <br />accessory building space. There is currently a one-stall, attached garage, which is 308 square feet <br />(14' x 22'), and a detached garage, which is 660 square feet (22' x 30'), on the subject property. <br />Thc applicant is proposing to construct an addition on the detached garage that would be 960 <br />square feet (24' x 40'). Including the proposed addition, there would be 1,928 square feet of <br />accessory building space on the property, which results in an overage of 264 square feet. <br /> <br />Assistant Community Development Director Trudgeon advised the applicant has stated that he <br />plans to convert the one-stall attached garage into living space, although that work would not <br />occur lot' several years. The applicant would like to exceed the size restriction in order to <br />construct an addition on the detached garage that would provide for more inside storage of <br />private use vehicles and equipment.
