Assistant Community Development Director Trudgeon advised the preliminary plat was approved ibr the whole phase, with this area as an outlot. Mayor Gamec asked if the costs are specified at the time of preliminary plat approval. Assistant Community Development Director Trudgeon replied it is stated whatever the charge is at the time of final plat is what the charge will be. He noted the trunk fees were increased by resolution, so they took effect immediately with no grace period. City Attorney Goodrich advised it should be researched if there are other developers in the same type of sitttation as Liberty Land Development, Councilmember Elvig commented this project has struggled and he hates to see it thrown back in a distressed situation. However, there may be other developers that will be in the same type of situation. City Administrator Norman advised at this time staff is looking for consensus. Rather than trying to develop language at this time, if there is direction from the Council, staff cm~ draft the proper language. Mayor Garnet noted the consensus of the Council seems to be to work out something to some extent with the trunk fees, however, maybe not the full charge, with the park and trail fees remaining as they are stated. Councilmember Strommen stated she is not comfortable moving forward without knowing the ramifications on other developments. Assistant Comm[mity Development Director Trudgeon indicated staff would need to bring back the agreement on the findings of fact for definite Council action, which needs to be slotted into the development agreement. He believes the developer would like to get started on the second phase; however, the development agreement cam~ot be signed until they icnow the numbers that will be used. Motion by Councilmember Cook, second by Councilmember Kurak, to approve the final plat of Village of Sunfish Lake 2~d Addition subject to compliance with City Staff Review Letter dared August 20, 2004, and the applicant entering into a Development Agreement with the City of Ramsey, contingent upon the legality of the sewer and water trunk tees being charged at the old rate and the park and trail fees at the current rate, to be reflected in the findings of ~'act. Further Discussion: Mayor Gamec indicated the question is whether it would be right to use the old fee or a negotiated tee. He thinks there is consensus to work out the fee. Councilmember Strornmen stated she cannot render an opinion when she does not know the consequences of that opinion. Councilmember Cook questioned how many people ~vould be affected if this action were to set a precedet~t, as far as notification.
