13. <br /> <br />14. <br /> <br />15. <br /> <br />16. <br /> <br />Sections 4.16, 4.17 and 4.19 of the Master Development Agreement are hereby deleted in <br />their entirety and amended to read as follows: <br /> <br />4.16 <br /> <br />INTENTIONALLY OMITTED. <br /> <br />4.17 INTENTIONALLY OMITTED. <br /> <br />4.19 INTENTIONALLY OMITTED. <br /> <br />Section 4.1 of the Master Development A~'eement is hereby amended to read as follows: <br /> <br />4.18 SPECIAL SERVICE DISTRICT - PARK IMPROVEMENTS. <br /> <br />The City may, in.the future, adopt an ordinance ordering a special service <br />district pursuant to Mi~mesota Statutes Chapter 428A to provide an <br />e~mnced level of park improvements within the Subject Property: If the <br />City establishes a special service district or special se~wice districts that <br />include all or a p6rtion of the Subject Property to finance the City's <br />construction and maintenance of an enhanced level of park improvements <br />within the Subject Property, the Developer for itself and its successors and <br />'assigns, hereby waives the right to object to the-establisl-u-nent of the <br />special service district pursuant to Mirmesota Statutes, Section 428A.02 <br />Subd. 4(1), Subd. 4(2) and Subd. 4(3); waives its right to appeal the <br />establisl-unent of the special service district pursuant to Mirmesota <br />Statutes, Section 428A.02, Subd. 5 and waives its right to file an objection <br />to the ordinance pursuant to Mirmesota Statutes, Section 428A.09, Subd. 2 <br />or any successor statute. Contemporaneously <br />with the execution of this First Amendment, the City, the Developer and <br />any other Interested Parties with any right, title or interest in the property <br />described on Exhibit M jail of the Commercial Property?} are executing <br />a Declaration of Restrictions, Covenants and Easements [to be prepared <br />by RTC/Mark Harnell which obligates and authorizes the City to operate <br />and maintain the T6v~n Center District and to assess .the lots therein for <br />such costs [entrance/monuments?]. <br /> <br />Sections 5.1, 5.2 and 5.3 of the Master Development Agreement are hereby deleted m <br />entirety. <br /> <br />Section 5.4 is hereby added to the Master.
