Absent: Chairperson Nixt. <br />NOTE CITY COUNCIL MINUTES <br />1) City Council regular meeting minutes dated May 11, 2004 <br />2) City Council regular meeting minutes dated May 25, 2004 <br />Vice Chair Johnson noted the City Council minutes. <br />PUBLIC HEARINGS/COMMISSION BUSINESS <br />Case #1: Request for a Conditional Use Permit for an Oversized Accessory Building; <br />Case of James and Diana Feigum <br />Presentation <br />Associate Planner Geisler noted the City has received an application from James and Diana <br />Feigum for a conditional use permit to exceed the maximum allowable square footage for <br />accessory buildings on properties between 1 and 1.99 acres as established in City Code on the <br />property located at 6321 163`d Lane NW. She indicated the subject property is approximately <br />1.2 acres (52,272 square feet) in size and is located outside the Metropolitan Urban Service Area <br />(MUSA). According to City Code, the property is eligible for 1,664 square feet of accessory <br />building space. <br />Associate Planner Geisler advised the proposed building will be 1,320 square feet (30' x 44') in <br />size and combined with the existing attached garage (624 sq. ft.), the applicant would have 1,884 <br />sq. ft. in accessory building space. She stated this results in an overage of 220 square feet. She <br />indicated the applicant would like to exceed the size restriction in order to construct a detached <br />accessory building that would accommodate the storage of private use vehicles and equipment. <br />Associate Planner Geisler explained the proposed accessory building will be located in the rear <br />yard, and will meet and/or exceed all setbacks established in the R-1 Rural Developing District, <br />and the materials will match the existing home. She indicated Staff recommends approval of the <br />request for a conditional use permit. <br />Citizen Input <br />James Feigum, 6321 163`d Lane stated this building will be built on an existing basketball court, <br />so the slab is already there, and that is the reason for requesting a bigger structure. <br />Motion by Commissioner Jeffrey, seconded by Commissioner Van Scoy to close the public <br />hearing at 7:15 p.m. <br />Planning Commission/July 1, 2004 <br />Page 2 of 13 <br />
