SPEAK~AN BABCOCK, LOCHER, NEILSON & MANNELLA ATTORNEYS AT LAW ANOKA, MINNESOTA 55MO3 TEL. 421-5151 AREA CODE 612 December 18, 1969 To The Ramsey Township Board and Township Clerk Ramsey Township, Anoka County, Minnesota At the regular Town Board meeting on Monday, December 15, 1969, when the issue of the Gilbert Menkveld petition for issuance of a mobile home park construction permit was considered, several issues were raised which I felt were important enough to require considerable legal research. I have conducted such research and have also met(on December 17, 1969) with Julian Hook, Special Assistant Attorney General for the State of Minnesota, and for almost two hours, discussed the petition, permit, and building plan and zoning ordinance and amendments thereto with him. Mr. Hook personally raises many points which I believe require a written Attorney General's opinion, for clarification of the position of the Town Board and to guide future actions by the Town Board. Mr. Hook personally feels that the Zoning Plan and Building Code, as adopted pursuant to M.S.A. 366.12 through 366.18, on March 30, 1951, is in order; and that the amendment thereof dated July 16, 1957, is also in order, proper published notice for the amendment being had. He feels that on the dates of the adoption of the same, that there was no requirement of publication of the Plan and Code or amendment after adoption. Mr. Hook personally does, however, feel that there is a requirement that the Township follow M.S.A. 412.221, Subd. 29, and now as replaced by M.S.A. Chapter 462, for any action affecting zoning from and after May 22, 1963, the date when the Township filed an approval of Chapter 157 with the Secretary of State, and that any and all ordinances adopted by the Township after said date must be published to be effective.
