SPEAK~AN <br /> <br />BABCOCK, LOCHER, NEILSON & MANNELLA <br /> ATTORNEYS AT LAW <br /> <br /> ANOKA, MINNESOTA 55MO3 <br /> <br />TEL. 421-5151 <br />AREA CODE 612 <br /> <br />December 18, 1969 <br /> <br />To The Ramsey Township Board <br />and Township Clerk <br />Ramsey Township, Anoka County, Minnesota <br /> <br />At the regular Town Board meeting on Monday, December 15, <br />1969, when the issue of the Gilbert Menkveld petition for <br />issuance of a mobile home park construction permit was <br />considered, several issues were raised which I felt were <br />important enough to require considerable legal research. <br /> <br />I have conducted such research and have also met(on December 17, <br />1969) with Julian Hook, Special Assistant Attorney General <br />for the State of Minnesota, and for almost two hours, discussed <br />the petition, permit, and building plan and zoning ordinance <br />and amendments thereto with him. <br /> <br />Mr. Hook personally raises many points which I believe require <br />a written Attorney General's opinion, for clarification of <br />the position of the Town Board and to guide future actions <br />by the Town Board. <br /> <br />Mr. Hook personally feels that the Zoning Plan and Building <br />Code, as adopted pursuant to M.S.A. 366.12 through 366.18, <br />on March 30, 1951, is in order; and that the amendment thereof <br />dated July 16, 1957, is also in order, proper published notice <br />for the amendment being had. He feels that on the dates of the <br />adoption of the same, that there was no requirement of publication <br />of the Plan and Code or amendment after adoption. <br /> <br />Mr. Hook personally does, however, feel that there is a <br />requirement that the Township follow M.S.A. 412.221, Subd. 29, <br />and now as replaced by M.S.A. Chapter 462, for any action <br />affecting zoning from and after May 22, 1963, the date when <br />the Township filed an approval of Chapter 157 with the <br />Secretary of State, and that any and all ordinances adopted by <br />the Township after said date must be published to be effective. <br /> <br /> <br />
