CC Regular Session 4. 9. <br /> Meeting Date: 04/25/2017 <br /> By: Chris Anderson, Community <br /> Development <br /> Information <br /> Title <br /> Adopt Resolution 417-04-092 Approving an Easement Encroachment Agreement for a Detached Accessory <br /> Building at 15359 Zuni Ct NW; Case of Steve and Christine Roeder <br /> Purpose/Background: <br /> The City recently processed an application from Steve and Christine Roeder(the "Applicant") for a variance to <br /> setbacks for a detached accessory building (the "Shed")located at 15359 Zuni Ct NW(the "Subject Property"). On <br /> April 6, 2017,the Planning Commission approved the requested variance contingent upon approval and execution <br /> of an Encroachment Agreement between the Applicant and the City. <br /> Notification: <br /> Notification is not required when considering an Encroachment Agreement. Staff attempted to notify all Property <br /> owners within 350 feet of the Subject Property of the Public Hearing that was held for the variance request via <br /> Standard US Mail. The Public Hearing for the variance request was also published in the City's official newsletter, <br /> the Anoka County Union Herald. <br /> Observations/Alternatives: <br /> The Shed is 120 square feet in size and is partially located within a Drainage and Utility Easement(the "Easement") <br /> on the Subject Property. The Easement does not include larger infrastructure such as storm sewer, sanitary sewer, <br /> or municipal water. The Engineering Department has reviewed this request and have no objection to the <br /> Encroachment Agreement. <br /> Funding Source: <br /> All costs associated with this request are the Applicant's responsibility. <br /> Recommendation: <br /> Staff recommends adopting Resolution 417-04-092 approving an Easement Encroachment Agreement for the Shed <br /> to remain partially within the Easement on the Subject Property. <br /> Action: <br /> Motion to adopt Resolution 417-04-092 approving an Easement Encroachment Agreement between the City and <br /> Applicant for the Shed on the Subject Property. <br /> Attachments <br /> Site Location Map <br /> Applicant Site Plan <br /> Letters of Support for the Variance <br /> Staff Review Letter <br /> Encroachment Agreement <br /> Resolution 417-04-092: Encroachment Agreement <br />
