On
April 6, 2017,the Planning Commission approved the requested variance contingent upon approval and execution
of an Encroachment Agreement between the Applicant and the City.
Notification:
Notification is not required when considering an Encroachment Agreement. Staff attempted to notify all Property
owners within 350 feet of the Subject Property of the Public Hearing that was held for the variance request via
Standard US Mail. The Public Hearing for the variance request was also published in the City's official newsletter,
the Anoka County Union Herald.
Observations/Alternatives:
The Shed is 120 square feet in size and is partially located within a Drainage and Utility Easement(the "Easement")
on the Subject Property. The Easement does not include larger infrastructure such as storm sewer, sanitary sewer,
or municipal water. The Engineering Department has reviewed this request and have no objection to the
Encroachment Agreement.
Funding Source:
All costs associated with this request are the Applicant's responsibility.
Recommendation:
Staff recommends adopting Resolution 417-04-092 approving an Easement Encroachment Agreement for the Shed
to remain partially within the Easement on the Subject Property.
Action:
Motion to adopt Resolution 417-04-092 approving an Easement Encroachment Agreement between the City and
Applicant for the Shed on the Subject Property.
Attachments
Site Location Map
Applicant Site Plan
Letters of Support for the Variance
Staff Review Letter
Encroachment Agreement
Resolution 417-04-092: Encroachment Agreement
