Councilmember introduced the following resolution and moved for its adoption: <br /> RESOLUTION#17-04-092 <br /> RESOLUTION APPROVING AN ENCROACHMENT AGREEMENT FOR A <br /> DETACHED ACCESSORY BUILDING TO BE PARTIALLY LOCATED IN A <br /> DRAINAGE AND UTILITY EASEMENT ON THE PROPERTY GENERALLY KNOWN <br /> AS 15359 ZUNI CT NW AND DECLARING TERMS OF SAME <br /> WHEREAS, Steve and Christine Roeder, hereinafter referred to as the "Applicant," have <br /> requested an Encroachment Agreement to allow a 10' x 12' shed (the "Shed") to be partially <br /> located in a drainage and utility easement (the "Easement") on the property legally described as <br /> follows: <br /> Lot 9, Block 1, Highlands at River Park 4th Addition, Except that part of said lot lying <br /> easterly of following described line: Commencing at the northwest corner of Lot 10 <br /> said Block 1, thence westerly along westerly extension of north line of said Lot 10 <br /> 35.73 feet to point of beginning of said line, thence southerly 134.09 feet to southwest <br /> corner of said Lot 10 and said line there terminating, subject to easement of record, <br /> Anoka County, Minnesota <br /> (the "Subject Property"). <br /> WHEREAS,the Applicant applied for a Variance for the Shed to deviate from the standard <br /> setbacks on the Subject Property; and <br /> WHEREAS, the Planning Commission approved the requested Variance contingent upon <br /> approval and execution of an Encroachment Agreement; and <br /> WHEREAS, the Applicant has applied for a Zoning Permit for the Shed; and <br /> WHEREAS, Engineering Department has found that the Easement can still function with <br /> the encroachment of the Shed; and <br /> WHEREAS, City Council reviewed the Encroachment Agreement request on April 25, <br /> 2017. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> RAMSEY,ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> 1. That, contingent upon the Applicant entering into an Encroachment Agreement with the City <br /> and recording said agreement against the Subject Property, the Applicant may construct and <br /> maintain the Shed in accordance with the terms and conditions contained within the <br /> Encroachment Agreement. <br /> The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br /> , and upon vote being taken thereon, the following voted in favor thereof: <br />
