7. The Park impact, proposed mitigation, and a proposed Section 4(f) de minimis finding will be <br /> reported in the Environmental Assessment (EA) that is being prepared for the Project. This <br /> EA will be published and a public hearing held to provide the opportunity for public <br /> comment on the features, activities and attributes of the Park. The final determination of <br /> Section 4(f) de minimis applicability will be made by FHWA following a review of any <br /> public comments received. <br /> 8. This Memorandum of Understanding will be re-evaluated and amended, if required, upon <br /> any of the following conditions: <br /> a. Proposal by any of the Signatory Agencies to implement specific Section 4(f) impact <br /> mitigation measures; and, as specific mitigation is defined, documenting the terms of <br /> agreement between M VDOT and the County of Anoka regarding the proportion of <br /> mitigation costs to be paid by each agency. <br /> b. Re-evaluation of the Project under NEPA. <br /> c. Request by any of the Signatory Agencies. <br /> -3 - <br />
