Board Member Johnson introduced the following resolution and moved for its adoption: RESOLUTION #02-11-280 A RESOLUTION 'ADOPTING FINDINGS OF FACT #0636 RELATING TO A REQUEST FROM RONALD CANNER, JR., FOR A VARIANCE TO THE SETBACK FROM THE ORDINARY H~GH WATER MARK AND THE COUNTY ROAD IN THE ROGERS LAKE SHORELAND OVERLAY DISTRICT FOR A NEW LOT PROPOSED TO BE PLATTED ON THE NORTH SIDE OF 179TM LANE N.W. (COUNTY ROAD #27), APPROXIMATELY 340 FEET WEST OF C.S.A.H. #7. WHEREAS, Rona[d Canner, Jr., hereinafter referred to as "Applicant", has properly applied for a Board of Adjustment variance from Section 9.21 (Environmental Protection), Subsection 9.21.04 (Shoreland Overlay District Development Standards), Subd. 5 (Zoning Provisions) of the Ramsey City Code on the property generally located.on the north side of 179~ Lane NiW. (County Road #27), approximately 330 feet east of C.S.A.H. #7, and proposed to be platted and legally described as follows: Lot t, Block l, L.P.Keillor Addition, Anoka County, Minnesota (the :iS ubj ect Property") NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF ADJ-USTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That the Applicant appeared before the Board of Adjustment for a public hearing pursuant to Section 9.03.05 of the Ramsey City Code on November 7, 2002, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. 2. That the Subject Property is zoned R-1 Residential and is approximately 2.5 acres in size. 3. That the surrounding parcels are also zoned R-1 Residential. 4. That the Subject Property is within the Shoreland Overlay District for Rogers Lake and is classified in the Ramsey City Code as a Natural Environment Lake. That Section 9.21.04 (Shoreland Overlay District Development Standards) of the Ramsey City Code requires a structure setback of 200 feet from the Ordinary, High Water (OHW) mark o£' Rogers Lake. q'h. at Section 9.20.11 (R-i Residential District) of the City Code requires a setback from major arterial roads or' 60 t'eet from the right-of-way centerline plus the local applicabie setback, which on the Subject Property would be the 40 foot front yard setback; fbr a total setback ot:' 100 feet from the right-of-way centerline of County Road #27.
