Counci Imember introduced the following resolution and moved for its adoption: RESOLUTION #04-09- A RESOLUTION APPROVING A REQUEST FROM BRIAN AND LAUREL JONES FOR A ()NE YEAR EXTENSION TO INITIATE THE VARIANCE TO THE STRUCTURE SETBACK IN THE ROGERS LAKE SHORELAND OVERLAY WHEREAS, Brian and Laurel Jones, hereinafter referred to as "Applicants'-", are requesting at one-year extension to initiate their variance from the minimum structure setback in the Rogers [,ake Shoreland Overlay District on the property-legally described as follows: Lot l, Block 1, L.P. Keillor Addition, Anoka County, Mim~esota (the "S ubj ect Property") WHEREAS, on November 7, 2002, the Ramsey Board of Adjustment granted a variance to the minimum structure setback requirements in the Rogers Lake Shoreland Overlay District; and WHEREAS, Section 9.03.07 (Variances), Subd. 4 (Lapse of Variance) of the Ramsey City Code states that unless otherwise specified, a variance shall become null and void one year afte,' final action by the Board of Adjustment if not initiated or utilized; and WHLREAS, the variance granted to the Applicants specified a two year time frame in which to initiate the variance or until November 7, 2004; and WHEREAS, Section 9.03.07 (Variance), Subd. 4 (Lapse. of Variance) of the Ramsey City Code further states that the applicant may request the City Council to grant an extension of time to complete or utilize the variance; and WItEREAS, on September 14, 2004, the City received a written communication from. thc Applicants requesting a one-year extension to utilize their variance granted on November 7, 2004. NOW TIIEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That the City Council hereby grants a one year extension endihg on November 7, 2005, Ibr the Applicantss to initiate the variance to the minimum structure setback in the Rogers Lake Shoreland Overlay District The motion for the adoption of the foregoing resolution was duly seconded by Councilmember , and upon vote being taken thereon, the following voted in favor thereof:
