CHAPTER 3 <br />COUNCIL PROCEDURES' <br /> <br />Section 3.1 Council Meetings. The council shall meet regularly at least once each month at <br />such times and places as the council may desi~mte by ordinance. The mayor or any p,vo !lzr¢:} <br />members of the council may call special meetings of the council upon at least twenty-£our hours <br />notice to each member, and such reasonable public notices as may be prescribed by council rule <br />in compliance with state statutes. The twenty-four hours notice shall not be required in an <br />emergency. A state of emergency shall be deemed to exist wl~en the public peace, health, <br />morals, safety or welfare are in immediate jeopardy. To the extent provided by state statutes, all <br />meetings of the council and its con-nnittees shall be public, and any citizen shall have access to <br />the minutes and records of the council at alt reasonable times. During any of its public meetings, <br />the council shall not prohibit, but may place reasonable restrictions upon citiz&ns' comments and <br />q~.~esrions and citizen input shall be provided for at the begim~ing of each council meeting. <br /> <br />Section 3.4 Ordinances, Resolutions and Motions. <br /> <br />3.4.1 Ex..cept as othm~,ise provided m this charter of state statutes, an affirmative vote <br />of il-u-cc four or more members of the council shall be required for the adoption of all <br />ordinances, resolutions and motions. The votes of councihnembers on any action taken <br />shall be recorded in accordance with state statutes. <br /> <br /> CHAPTER 4 <br />NOMINATIONS AND ELECTIONS <br /> <br />Section 4.5 Vacancy of Municipal Elected Office. <br /> <br />4.5.5 When a vacancy in an elected office of the city occ~.trs within 120 days prior to a <br />regular municipal election date, the special election to fill the vacancy shall coincide with <br />the regular election. If the vacancy occurs within sixty days prior to the regular election <br />dare, the notice of such vacancy shall be published as soon as is practicable. If, within <br />the 120 day period before a regular municipal election, the vacancy occurs m the office of <br />the mayor or in the office of either or both of tiao councilmembers whose seats m'e to be <br />decided in the election, said vacancy shall be considered i~ot to exist for the puq~oses of <br /> <br />NOTE: WITH THE ADOPTION OF THE WARD AND PRIMARY ELECTION <br />SYSTEMS THIS PROVISION DOES NOT WORK FOR THIS TYPE VACANCY. <br />THE CHARTER COMMISSION NEEDS TO PROVIDE ADDITIONAL <br />DIRECTION ON HOW TO RESOLVE THIS ISSUE. <br /> <br /> <br />
