Chairperson Nixt noted if the property owner is allowed to develop an area now he has benefited
from the process. He then waits on the remainder of the land until sewer and water comes and
can then develop the remainder of the land. He would actually gain the raw land net of what the
City will take for normal infrastructure to allow him to develop those other units.

Mr. Engstrom requested that the residents receive notification of any other meetings.

Chairperson Nixt questioned what staff is looking for from the Commission tonight.

Assistant Community Development Director Trudgeon replied staff would like a
recommendation to the Council. He noted the moratorium expires September 12th.

Chairperson Nixt stated there have been some meaningful comments tonight that need to be
considered and evaluated befor~ the ordinance goes forward.

Assistant Community Development Director Trudgeon indicated the Commission can have more
discussion if they would like. He is a little worried about the expiration of'the moratorium. He '
explained a 90 day moratorium was instituted but this may be a bigger issue that takes more than
90 days. This discussion will likely be on the agenda of the August 24th City Council meeting.

Mr. Zaetsch suggested notice of meetings be posted on the City website. He stated the agenda
for this meeting was not emailed today. They found out about it through word of mouth fi'om a
councilmember, and another councilmember did not know there would be a public hearing on
this issue. Notice did not get out. He stated there is also a problem with the turnaround on the
minutes. The last set of minutes available from the City is from July 3''d.

Assistant Community Development Director Trudgeon indicated staff went above and beyond
requirements by notifying property owners with five acres or more and also running a notice in
the newspaper. Staff would be more than happy to post it on the City website. He does not
know what happened with the Planning Commission agenda being emailed, but the Council is
aware of the Planning Commission agendas.

Chairperson Nixt explained state law requires notification to be given to the people that are
logically most affected by the ordinance, and there are others that have interest in the ordinance.
The City will try to provide more notice to those not legally required. He-noted there have been
a number of comments raised, and some practical ramifications associated with the concept. He
is not altogether concerned about the homeowners association. He asked if the City has thought
through the functioning private systems and if the concept of clustering with private septic and
wells is practical and pragmatic.

Assistant Community Development Director Trudgeon replied there are a lot of other examples
in the metro area, if not the nation, of cluster develoPments working. The key is to make sure
that the common septic system is monitored. It may require an escrow to put up by the
developer in the forefront for replacement of the system so there are sufficient funds if it does
fail. l-le indicated staff would like this to go before the Council to try to respect the moratorium.
It may take the Council several meetings to go through this.

Planning Commission/August 5, 2004
