4) Consider Feasibility Study on St. Francis Boulevard Frontage Road Moved up in the agenda to follow Case 4/1, ~) ~ Snow Removal Issues in Ramsey Town Center Assistant Public Works Director Olson repOlied the Public Works Committee ran short on time for this discussion. The motion was to table the discussion of the topics and take them a few at a time at upcoming Public Works meetings. There is a long list that needs to be discussed, and they will address t\VO or three of the issues per Public Works Committee meeting. No Council action required. Case #5: Nuisances Affecting Public Peace Police Chief Way indicated this issue has been discussed at length. Staff recommends amending Section 5.08 "Public Nuisance" by repealing the existing section and replacing it with the new Section 5.08. Councilmember Strommen commented she checked and it was detennined this ordinance does not require a public hearing. She suggested anyone with comments regarding this to attend the next City Council meeting when this ordinance will be adopted. Motion by Councilmember Cook, second by Councilmember Elvig, to introduce an ordinance amending Section 5.08 titled "Public Nuisance: by the repeal of said existing section and replacing it with a new section 5.08, which new section shall continue to be titled :Public Nuisance. " Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Elvig, Kurak, Strommen, and Zimme'nnan. Voting No: None. Absent: Councilmember Pearson. Case #6: Authorizing Acquisition of Permanent Street and Utility Easements Necessary for the Extension of 160111 Lane NW City Attorney Goodrich explained on July 27, 2004, the City Council reviewed the appraisals regarding tree damage and the possible purchase of a 66-foot wide road easement through the Steve and ChTisty Dusbabek and Francis and Lori Kaas properties, The City Council voted to acquire the property through negotiations or eminent domain if necessary. Staff is bringing forward a resolution that would authorize the use of eminent domain to purchase the property in order to keep to the designated timeline of all parties, He noted the following amendments to the proposed resolution: · An additional whereas to state "\Vhereas the City Council by resolution on July 27, 2004 established conditions on the use of the easement to be acquired." · An addition of #8 to state "The pennanent easements are to be acquired pursuant to the conditions established by City Council resolution on July27, 2004."
