Councilmember Zimmelman commented this is a good use of the City Stonnwater Utility Fund. If this amount was added to this local problem it would really be a burden on the homeowners in that area. Assistant Public Works Director Olson indicated the Shumway case discussed earlier is another example of the reason for the Stonnwater Utility Fund. There is a need to get drainage onto some of these streets and to maintain a good road system. Motion by Councilmember Elvig, second by Councilmember Cook, to approve Resolution #04- 08-218 awarding Project #04-24 Helium Street/169/h Avenue Drainage project to Penn Contracting, Inc. in the amount of $66,240. Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Cook, Kurak, Strolmnen, and Zimmemlan. Voting No: None. Absent: Councilmember Pearson. Case #8: Request for Final Plat Review of Alpine Acres 3rd Addition; Case of Oak Creek Builders Community Development Director Frolik indicated Oak Creek Builders has applied for final plat approval of Alpine Acres 3rd Addition. This final plat confonns to the preliminary plat. Park dedication, trail fees, and stonn water management fees for the third phase will consist of a cash payment. She noted the City recently established an ordinance adopting NfN State Building Code Amendment 1306. A portion of the amendment requires residential dwelling stmctures over 8,500 square feet in size to install a fire sprinkler suppression system. In the case of Alpine Acres 3rd Addition, a signitlcant portion of the streets and infrastmcture is already constmcted within the third addition. In order for Alpine Acres 3rd Addition to comply with 1306, the existing streets will have to be removed, infrastructure resized, and streets reconstmcted. Staff does not see the advantage of disturbing existing streets and infrastmcture; therefore, in situations where a residential stmcture is located adjacent to existing streets and infrastmcture that was installed prior to July 23, 2004, staff suggests that the City waive the amended 1306 compliance requirement. She advised staff recommends final plat approval of Alpine Acres 3rd Addition, waiving the requirement of the fire suppression equipment, but would like to reserve the right to verify the trail constmction credit due in item # 1 9 of the development agreement with the Engineering Department. Councilmember Zimmennan asked if a future homeowner could put in the fire suppression by themselves. Public Works Director Kapler replied every home could do that. The issue was with the infrastructure in the street; the stub size is too small and staff thought it would be an undue burden to tear up the street and redo the water. He explained each unit could do this on their own if they would like. Councilmember Cook noted there are ways to do this without using City water pressure.
