Case #9:

Request for Final Plat Revie\-v of Alpine Acres 4th Addition Case of Oak
Creek Builders

Community Development Director Frolik advised Oak Creek Builders has applied for final plat
approval of Alpine Acres 4th Addition. This has the same situation with the tIre sprinkler
suppression system; however, Alpine Acres 4lh Addition contains 16 units where streets and
infrastmcture has not been installed to date. Compliance with amendment 1306 is a transitional
period and best efforts should be made to comply with the fire sprinkler suppression requirement,
however, due to the fact that only eight percent of the development has the potential to be
serviced by fire sprinkler suppression, staff is recommending that the City waive the fire
suppression requirement in this case. Park dedication, trail, and stonn water would be a cash
payment. There is a con'ection to the development agreement with trail fees due at $23,100. As
in the previous case staff would like to reserve the light to verify the trail constmction credit due
in item #19 of the development agreement with the Engineering Department.

Councilmember Elvig inquired about the setbacks in this area. He noted they had negotiated to
have them set back in Phase 2, and they appear to be out on the road in this plat.

Assistant Public Works Director Olson explained this is what was negotiated at the time of
preliminary plat. To shift a building pad they would have to ask them to change the preliminary
plat and the grading plan.

Councilmember Elvig asked how far the setback is.

Community Development Director Frolik replied the setback is at 42 feet; the minimum is 30
feet.

Councilmember Strommen inquired about lots 8, 9 and 10, which seem to overlap 'vvith the
delineated wetland.

Assistant Public Works Director Olson replied he believes the developer has received a WMO
pennit. It may have been that there will still be a drainage and utility easement even though the
lots are being platted. If they are infringing it would be less than the minimum amount and it
will not require mitigation. He recalls that was an issue and can double check that. He advised
this tlnal plat is substantially in confonnance with the preliminary plat that was approved and
suggested a motion be made to witliliold the building pe1111it for lots 8 through lOon Block 2
until it is velified that the wetland issue has been resolved.

Motion by Councilmember Cook, second by Councilmember Elvig, to adopt Resolution #04-08-
220 approving the final plat of Alpine Acres 41h Addition contingent upon compliance with City
Staff Review Letter dated July 23, 2004 and the Developer entering into a Development
Agreement with the City, waiving the requirement of the fire suppression equipment, reserving
the right to verify the trail construction credit due in item # 19 of the development agreement with
the Engineering DepaJ1ment, and withholding the building pe1111it for lots 8 through lOon Block
2 until it is velified that the wetland issue has been resolved.

City Council/August 10, 2004

P38
